1. Acceptance of Terms
By accessing or using the MBR Hawks website (mbrhawks.com) or engaging our agency services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must discontinue using our website and services immediately.
2. Scope of Services
MBR Hawks provides end-to-end digital solutions, including:
- Digital Product & Web Development: Custom software, websites, web applications, eCommerce, and mobile apps.
- Growth & Performance Marketing: SEO, paid advertising (Google, Meta, TikTok), conversion rate optimization, and content strategy.
- AI Automation & Intelligence: Workflow automation, conversational agents, custom LLM systems, and BI dashboards.
- Dedicated Remote Staffing: Vetted engineers, marketers, customer support, and operational virtual assistants.
3. Intellectual Property Rights
All custom deliverables developed specifically for a client under a fully executed agreement become the intellectual property of the client upon receipt of full payment, subject to terms specified in the individual Statement of Work (SOW). All pre-existing frameworks, proprietary tools, website design, trademarks, and brand assets of MBR Hawks remain the sole property of MBR Hawks.
4. Client Responsibilities
Clients agree to provide timely feedback, required project assets, clear instructions, and accurate business credentials necessary for project execution. Delays in providing necessary materials may extend agreed-upon delivery timelines.
5. Limitation of Liability
To the maximum extent permitted by applicable law, MBR Hawks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services. Our total liability for any claim shall not exceed the amounts paid by the client to MBR Hawks during the six (6) months preceding the incident.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
